Ukraine CLP Regulation Enters into Force Today!
As of 15 November 2024, the Technical Regulation “On the Classification, Labelling, and Packaging of Chemical Products” (UA CLP) is officially in force. This milestone represents a significant step in Ukraine’s alignment with EU chemical safety standards. The full text of the resolution on approval of the regulation is available here.
The implementation of UA CLP is part of a broader reform initiated by the Law of Ukraine “On Ensuring Chemical Safety and Management of Chemical Products” (UA LCS), which entered into force on 29 June 2024. The next major step in this reform is the implementation of the Technical Regulation on the Safety of Chemical Products (UA REACH), scheduled for 26 January 2025.
Main Obligations Under UA CLP
- Manufacturers, importers, and downstream users of chemical products are required to:
- Classify chemical products in accordance with UA CLP rules and criteria.
- For chemical products classified as hazardous:
- Ensure proper packaging to meet safety standards.
- Apply hazard information on the packaging or container.
These requirements are crucial for ensuring that chemical products comply with internationally recognized safety standards, thereby enhancing market transparency and safety for users.
Transitional Period for Products Already on the Market
Chemical products placed on the market before 15 November 2024 that do not comply with UA CLP requirements can continue to be supplied until 15 November 2025. After this date, all products must fully comply with the regulation.
CLP Notification Requirements
In addition to general compliance, hazardous substances are subject to notification obligations under UA CLP:
- Hazardous substances already on the Ukrainian market before 15 November 2024 must be notified to the competent authority by 15 November 2025.
- Hazardous substances placed on the Ukrainian market for the first time after 15 November 2024 must be notified within 30 days of their first placement on the market.
