India BIS Update: Flashlight, draft Quality Control Order

The Department for Promotion of Industry and Internal Trade, Ministry Of Commerce And Industry, Govt of India had notified draft Quality Control Order (QCO) vide dated 13.11.2024 for Flashlight as listed below for consultation and offering comments on SPS & TBT Platform of World Trade Organization.

Description of the product: A small,  portable   electric   lamp   powered   by   replaceable   primary   batteries   and replaceable/built-in secondary batteries with a maximum voltage of 48 V DC

Post adoption, the Ministry will publish the above QCO in the Gazette of India’s website making it mandatory to follow the QCO for importing Flashlight into India. 

Upon implementation, it will be mandatory for both domestic and international manufacturers to comply with Indian Standard IS 2083:2024. They must also display the Standard Mark, which is to be obtained through a license from the Bureau of Indian Standards (BIS), in accordance with Scheme-I detailed in Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. The use of the Standard Mark will be regulated by the Bureau of Indian Standards Act, 2016, and its associated Rules and Regulations. The Bureau of Indian Standards will act as the certifying and enforcing authority. 

The objective of the QCO is Prevention of deceptive practices and  consumer  protection;  Protection  of human health or safety; Protection of the environment.

Date of implementation in General (other than Micro and Small Enterprises)

Date of implementation for Small Enterprises

Date of Implementation for Micro Enterprises

6 months from the date of publication of QCO

9 months from the date of publication of QCO

12 months from the date of publication of QCO

 Final date for comments: 60 days from notification i.e., 06.12.2024
