REACH, the EU’s chemicals regulation in effect since 2007, requires companies to register substances with ECHA before manufacturing or importing REACH-regulated substances in quantities of ≥1 tonne per year into the EU/EEA. Pre-registration is no longer accepted; therefore, full registration is mandatory, and non-compliance may result in denied market access and fines.

Therefore, India-based manufacturers or formulators exporting chemical substances to the EU—or operating through EU subsidiaries—should prioritize compliance in the following areas:

• Identifying all substances subject to REACH in their portfolio that are being manufactured, imported, or placed on the EU market.
• Determining applicable registration obligations under REACH.
• Seek for an experienced Only Representative (OR) in the EU, if they wish to manage REACH compliance as a non-EU manufacturer/formulator.
• Prepare and submit complete registration dossiers in a timely manner.
• Maintaining up-to-date dossiers and meeting all post-registration obligations
