On the 17th of February, Eurasian Economic Commission (EEC) released new drafts of the 2nd tier implementing regulations under Technical Regulation on Safety of Chemical Products TR041 ( “Eurasia REACH”) for public consultation for which time-window ended on the 1st of April. The new drafts are expected to be revised based on the public consultation comments and might be approved in the second half of 2021.
Under Eurasia REACH companies placing chemical products on the Eurasian Economic Union – Russia, Belarus, Kazakhstan, Kyrgyzstan and Armenia – are required to have a GOST 30333-20XX compliant chemical safety passports (including C&L according to the applicable GOST standards), complete new substances notifications for substances not listed in the chemicals inventory and register chemical products (substances, polymers or mixtures). Similar to EU REACH, non-EAEU companies can appoint an Authorized Representative in the EAEU for the purposes of compliance with the technical regulation requirements.
Initially Eurasia REACH was planned to come into force on the 2nd of June 2021 however due to number of delays the newest date proposed by the EEC is 30 November 2022 which might be shifted even further if the 2nd tier regulations remain unapproved.
